SAR-MAR s.r.o. supplies factory-new replacement engines.

This Warranty Policy explains the voluntary commercial warranty offered by SAR-MAR s.r.o. It does not limit any mandatory rights granted to consumers under applicable law.

1. Statutory Consumer Rights

If you are a consumer, you may have mandatory statutory rights under applicable law, including rights relating to goods that are defective or not in conformity with the contract.

Those rights apply independently of this Warranty Policy and are not limited, excluded, or replaced by it.

2. Voluntary 12-Month Commercial Warranty

In addition to any mandatory statutory rights, SAR-MAR s.r.o. provides a voluntary 12-month commercial warranty for factory-new replacement engines supplied by us, subject to the conditions set out in this Warranty Policy.

The 12-month commercial warranty period begins on the date of installation of the engine, as evidenced in accordance with Section 4 below, and in any event no later than 30 calendar days after delivery, unless otherwise agreed by SAR-MAR s.r.o. in writing.

This commercial warranty applies only to defects in the supplied engine that arise under normal, intended use and that are not excluded under this Warranty Policy.

3. Scope of the Commercial Warranty

Subject to these terms, SAR-MAR s.r.o. warrants that the supplied engine will be free from defects in material and workmanship during the 12-month commercial warranty period.

At the option of SAR-MAR s.r.o., and to the extent permitted by law, the remedy under this commercial warranty shall be limited to one of the following:

  • repair of the engine,
  • replacement of the engine,
  • supply of equivalent replacement parts,
  • or refund of the price paid for the engine or the defective part, in whole or in part.

Any remedy under this commercial warranty is subject to inspection and confirmation by SAR-MAR s.r.o. that the claim falls within the scope of this Warranty Policy.

4. Required Warranty Registration Documents

As a condition of this voluntary 12-month commercial warranty, the buyer must provide the following documents to SAR-MAR s.r.o. within 5 business days after installation:

  • proof of purchase,
  • proof of installation date,
  • proof of vehicle identification details,
  • the engine code,
  • clear proof of the odometer / kilometre reading of the vehicle at the time of installation,
  • and, where installation was carried out by a workshop, the workshop invoice or installation report.

The proof of kilometre reading must clearly show the vehicle mileage at installation.

This requirement is used to determine the starting point and typical use of the engine for the purposes of this voluntary commercial warranty.

Failure to provide the documents listed above within the stated period may result in loss of eligibility for this voluntary 12-month commercial warranty. For consumers, this does not affect any mandatory statutory rights under applicable law.

5. Conditions of Warranty Validity

This voluntary commercial warranty applies only if:

  • the engine code and application were verified before ordering,
  • the engine was inspected before installation,
  • the engine was installed correctly and professionally,
  • the engine was used only for its intended purpose,
  • all manufacturer-recommended procedures, service intervals, fluids, filters, and installation requirements were followed,
  • all ancillary components reasonably necessary for correct installation and operation were inspected and, where required, replaced or serviced,
  • and the engine has not been modified, abused, overheated, run without proper lubrication or cooling, contaminated, or otherwise improperly handled.

SAR-MAR s.r.o. may require maintenance records, diagnostic reports, workshop notes, photographs, and other reasonable supporting evidence to assess a claim.

6. Exclusions from the Commercial Warranty

This voluntary 12-month commercial warranty does not cover:

  • incorrect selection of engine by the buyer, workshop, or installer,
  • incompatibility where the supplied engine matches the engine code and specification confirmed in the order,
  • improper installation or attempted installation,
  • failure to replace, service, or correctly connect ancillary components where reasonably necessary for proper installation or operation,
  • use of incorrect, poor-quality, or contaminated oil, coolant, fuel, filters, or other consumables,
  • overheating, seizure, detonation, lubrication failure, contamination, neglect, accident, misuse, or abnormal use,
  • unauthorised repair, dismantling, modification, tuning, or alteration,
  • racing, competition, commercial overload, or other use outside normal intended operation,
  • normal wear and tear,
  • external components, accessories, sensors, belts, hoses, wiring, electronics, gaskets, turbochargers, injectors, pumps, or ancillary parts unless expressly included in writing,
  • labour costs for removal, installation, diagnosis, downtime, towing, transport, substitute vehicle costs, loss of profit, loss of business, or any indirect or consequential loss, unless mandatory law requires otherwise.

7. Warranty Claim Procedure

If you believe you have a warranty claim, you must notify SAR-MAR s.r.o. without undue delay after the issue is discovered and before any further use, dismantling, repair, or modification of the engine, except where necessary to prevent further damage.

A claim must include:

  • proof of purchase,
  • the warranty registration documents listed in Section 4,
  • a description of the defect,
  • photographs or video of the engine and affected parts,
  • a diagnostic report or workshop findings, if available,
  • and any other information reasonably requested by SAR-MAR s.r.o.

No repair, dismantling, or third-party work may be carried out under this commercial warranty without prior written approval from SAR-MAR s.r.o., except where necessary to prevent immediate further damage.

8. Inspection and Return for Assessment

SAR-MAR s.r.o. reserves the right to inspect the engine, require its return, or appoint a third party to examine it before deciding on the claim.

The buyer must preserve the engine and all relevant parts in the condition in which the issue was discovered so that an inspection can be carried out.

If a returned engine or part is found not to be covered by this Warranty Policy, SAR-MAR s.r.o. may reject the claim and charge reasonable inspection, handling, storage, and transport costs to the extent permitted by law.

9. Relationship with Statutory Rights

For consumers, this voluntary commercial warranty is provided in addition to, and does not affect, mandatory statutory rights under applicable consumer law, including rights relating to non-conforming or defective goods.

For business customers, this Warranty Policy applies only to the extent expressly agreed by SAR-MAR s.r.o. and may operate as the exclusive contractual warranty to the extent permitted by applicable law.
